City of Plano Smokefree Ordinance

The United States Surgeon General, in the 2006 report on “The Health Consequences of Involuntary Exposure to Tobacco Smoke” stated that scientific evidence indicates there is no risk-free level of exposure to secondhand smoke.
The report goes on to say that the operation of heating, ventilating and air conditioning systems can distribute secondhand smoke throughout a building. A smokefree policy is the only effective way to ensure that secondhand smoke exposure does not occur.

On April 9, 2007 the City of Plano passed Ordinance # 2007-4-6 designating the City of Plano smokefree in public places and places of employment.

The purpose of this ordinance is to improve and protect the public’s health by eliminating smoking in public places and places of employment.

The ordinance will become effective June 1, 2007. The ordinance restricts smoking in all indoor, enclosed public places and places of employment. This will include, but is not limited to: common work areas, auditoriums, classrooms, conference and meeting rooms, private offices, elevators, hallways, waiting rooms, employee lounges, stairs, restrooms, service lines, food establishments, lobbies, and all other enclosed facilities. The ordinance will also prohibit smoking within 25 feet of any door, operable window or vent or other opening to the indoor enclosed area.

Smoking will be allowed in retail tobacco stores that are in stand alone buildings, in personal automobiles, and in private residences, except if the residence is used as a child care, adult day care or health care facility. Also, not more than ten percent of hotel and motel rooms rented to guests may be designated as smoking rooms.

Businesses are to post signs at the each front entrance, back entrance and restroom entrances within the premises. The international “No Smoking”
symbol may be used. Businesses are not to provide ashtrays, lighters, matches or other smoking related paraphernalia. Persons smoking in a prohibited area are to be informed they are in violation of the ordinance. If the person willfully continues to smoke the person will be asked to leave.
